Rares' Judgment was forensic, he carefully set out the facts as presented BY ASHBY in the Pleadings, the way the litigation was conducted, and he painstakingly set out the Law, citing relevant cases. It was a well considered, and well presented, solid and I believe, bullet proof decision. If Ashby does appeal....and he has not yet done so.....all he has done is announce an intent to Appeal, it will not succeed in my view. What is remarkable is that Harmer's, the Lawyers who also copped a caning from Rares will continue to act for Ashby. That is unethical, and I reckon it will be made the subject of very critical comment. According to Rares, Harmer's stuffed up professionally, they were negligent, and that has cost Ashby. Ashby could sue Harmers. So, they (Harmers and Ashby) have separate interests in the matter....their interests are not mutual. In fact, they now have conflicting interests, and thus Harmers ought no longer act for Ashby in this matter. I reckon you will hear more along those lines.

As for the action to be commenced at FWA....well, I really know nothing about how that beast works, apart from reading how they cocked up big time with Thomson. BUT, common sense dictates that if a Judicial Officer (Rares) has determined Ashby's cause is vexatious and an abuse of process, one would expect FWA would make exactly the same finding.

Yes, one thing is clear.......someone has very big pockets....or Ashby is getting all this assistance gratis, which makes it even more certain the whole thing is politically motivated. There ought be no doubt in anyone's mind that if Slipper was not an MHR in a delicately balanced Parliament.....no-one would give a fig about this litte prick's pathetic problems, and if he wanted them to act on his behalf in what is pretty complex stuff, he would be charged just like any other client would be. Money up front, and in the Lawyer's Trust Account.

Judges make decisions based on what is there before them. That is what Rares did, and it is what he is paid to do. What he says counts. What the fuckwits like Akerman, Smith, Hudson, Pickering et al is piss and wind crap, and counts for nothing in the real legal world.

It's obvious you haven't.
No Aussie, if you read the bloody thing you will know that he made many assumptions about Brough and his involvement, this coloured his judgement. Mind you Roxon could have too, but that is just speculation. The assumptions would require him to be a mind reader for them to be able to prove them factual. (After he proves he actually is a mind reader of course)
