Rares' Judgment was forensic, he carefully set out the facts as presented BY ASHBY in the Pleadings, the way the litigation was conducted, and he painstakingly set out the Law, citing relevant cases. It was a well considered, and well presented, solid and I believe, bullet proof decision. If Ashby does appeal....and he has not yet done so.....all he has done is announce an intent to Appeal, it will not succeed in my view. What is remarkable is that Harmer's, the Lawyers who also copped a caning from Rares will continue to act for Ashby. That is unethical, and I reckon it will be made the subject of very critical comment. According to Rares, Harmer's stuffed up professionally, they were negligent, and that has cost Ashby. Ashby could sue Harmers. So, they (Harmers and Ashby) have separate interests in the matter....their interests are not mutual. In fact, they now have conflicting interests, and thus Harmers ought no longer act for Ashby in this matter. I reckon you will hear more along those lines.Meanwhile... Ashby is appealing and going to Fair Work with his claims about Slipper..

Judges make decisions based on what is there before them. That is what Rares did, and it is what he is paid to do. What he says counts.
