If Trump does not concede, does the vote then go to the House of Representatives...
(12th Amendment....)
The House has a Republican majority....
My understanding is that all Trump has to do is refuse to concede...
AND the majority in the House ensures he remains President.....
We have had 2 candidates refuse to concede the election in our history, in 1800 and 1824. If after the electoral college cannot reach a definite decision, the decision goes to Congress. I need to read up on this. This is covered in the 12th Amendment of our Constitution. Our language has changed and I need to reread it more carefully. I believe it comes down to each state getting 1 vote to choose the president in the House and the Senate chooses the vice president. It could really be a screwed up situation, but 37 states are Republican controlled, so Trump has an extreme advantage over Biden here.
If after the electoral college cannot reach a definite decision, the decision goes to Congress.
Regarding the President, that would only be the case if it was a draw in college votes each received as I read it, not someone dummy spitting!

Anyway the final count will determine that.
If the colleges dont give Biden their vote, And the are not legally bound to do so, he will not be the President , A highly unlikely scenario I will admit

My understanding....
The votes of the people have to be counted by each State by the 14th December, 2020.
If each states delegates of the Electoral College cannot finalize their count
by the 14.12.2020, my understanding is that it would then go to Congress, where
Trump would be re-elected due to the majority the Republicans have.
Each state having one vote for the President and one vote for the Vice President....
The delegates of each state can only certify their numbers if the counting is complete.
I would think that the delaying tactic used by Trump to go to the Courts is a brilliant
legal move.
It only has to slow down everything until the 14.12.2020.
The 279 votes that Biden has at the moment is an insignificant number if by the 14th
December, 2020, the delegates cannot certify the finality of voting.
Time is of the essence for Biden to win.
Thats my understanding.

I think any attempt to delay any recounts intentionally would end up in civil war !

From what Ive read recently, the 14.12.2020 deadline was always going to be difficult for many
States to abide by. The problem has been worsened by the huge number of mail ins...
The more vote counting controversies arise, the slower the process...
All the more reason for the voting system to be streamlined..

I am not sure that recounts would take as long as the original counts as the state would just use lots more counters and the votes would be still boxed (or similar)

Anyway we shall see!
