Hey, Rambo.....can you please tell us some more about how illegal it is that there is no bi-election to fill the Senate vacancy created upon Abib's resignation? We are all eyes.

Thought you reckoned you were a lawyer.
Well mugsly, believe it or not, in a Westminster democracy a parlimentary or senate seat is won by a candidate elected by a ballot of voters. So if an elected member quits/resigns, their seat cannot be given, sold, or raffled off by that member's colleagues. It can only be re-won via a by-election.
I suggest you read the first chapter of the Australian Constitution mugsly.

Labor cried for years that it was illegal, as it allowed the Libs to block supply in the senate, leading to Gough Whitlam's sacking on 11/11/1975.

There is a section down the page a bit (sec. 15), about replacing senators without an election, if a vacancy arises.

Do you really want to keep digging this hole, Rambo? The facts are:Gillard, nor anyone in federal parliament is entitled to appoint a senator for a state, only a state government or in their absence a state governor can do that.
As a Lib state govt is unlikely to choose a Lab appointee, a by-election is due.
Read the 1st chapter of our constitution. It states so quite clearly.
1. A Senator, a Labour Senator has resigned creating a casual vacancy in the Senate.
2. His replacement must be decided by the Government of his home State....in this case, NSW.
3. Constitutional Convention demands that, given the bloke who resigned was elected as an ALP candidate, the State Government will appoint an ALP man to fill the vacancy.
4. Hence the hue and cry when Joh the Jerk appointed that dick-head Field to fill a casual vacancy. (I gave you plenty of hints up there ^^^ to alert you to reality.)
So....behind the scenes, you can bet that Gillard et al have all their ducks lined up, including the Liberal Government of NSW, to facilitate the appointment of Carr.
She gets things done.
