So, wouldn't it be illegal to pay someone to do something illegal (ie. smuggle you in)?
Obviously not. Res ipsa loquitur.
So, arsie... wanna explain what "speaks for itself"?
Paying someone to pervert the course of justice is seen as bribery. Paying a thug to murder or assault someone is conspiracy...
... so obviously there are plenty of examples of cases where paying others to perform illegal acts are deemed to be illegal.
Do you have a point to make?

You work it out. Go back to your question, and then ask yourself who has been charged. People movers, or those who paid them.......

Possibly. That was not sprints intent in the use of the word however- he intended to say they were trying to enter the country illegally, and asylum seeking is not illegal..

Probably a jurisdiction issue. They give the pay off before they enter the country.

I suppose the definition of illegal would depend on what intention they have in being bought into Australia. If they intend to sail to Christmas Island, and say I'm seeking political asylum (which isn't illegal) then even paying someone to do that wouldn't be considered illegal.
If they won't to be dropped in the Kimberlys and given free range, (Good luck with that plan) that would be illegal.
The Mayans predicted the end of the world in December 2012, but they didn't see the Spanish coming

Saw a suggestion reported in a paper somewhere that the asylum seekers have access to medicare whilst in detention. I think i agree with that. Perhaps there could be more home/family styled detention centres- or maybe they could be called reception centres instead.
