This is interesting. After a spate of recent cases where men paying child support won a refund after discovering that the child wasn't theirs, the Rudd government is moving to ban paternity testing without consent and the disclosure of the results.

I'm not sure why this is an issue in the first place. Surely the onus is on the mother to prove that a man is the father before she can force him to pay child support. Thus the man could get the test done and if it shows the child isn't his, simply deny that the child is his and stop paying child support.

Wait.. does this include the fuzz? So the whole offering the suspect a glass of water during the interrogation and running DNA on the glass will be illegal now? Does this mean the whole criminal DNA library they're working on in WA will be an inadmissable waste of money?


Fuck people are precious about their DNA aren't they? This little molecule seems to have reached religious status with the amount of unwarrentd protection it now receives.


Anyway, I agree that it seems ass about. In order to demand child support, the burden of proof should be on the plantif and not the defendant anyway. Though I'm pretty happy for paternity to be assumed if the defendant refuses to submit a sample.

I think that overall, this is a good change. Intimate personal information should be protected from theft.

But something needs to be done about false claims of child support. Perhaps mandatory paternity tests? How much do they cost anyway?
