The primary obligation of the Governor is to oversee the workings of the government of the day to ensure that it acts within the boundaries of the Victorian Constitution and the rule of law. Thus the Governor is, in effect, a steward of our democratic framework and has certain powers and rights which may be exercised to achieve this. These powers and rights are described later.

Given the Governor’s place as the head of Victoria’s constitutional structure, it is important that the Governor remains apolitical and impartial. It is for this reason the Governor does not vote in elections.

The main constitutional responsibilities of the Governor in relation to the function of the government of the day are to:

call an election

- chair the Executive Council

- give Royal Assent to Bills passed by both Houses of Parliament

- dissolve the Legislative Assembly in exceptional circumstances

- appoint and dismiss Ministers.
Giving Royal Assent

A Bill is a proposed Act that has not yet been passed by the two Houses of Parliament or has been passed but has not yet received Royal Assent. Once a proposed piece of legislation is passed by the two Houses and is given formal approval by the Governor – that is, given Royal Assent – it becomes an Act of Parliament and becomes the law of Victoria.

The Governor also has the right to warn the Premier (or Minister) of the consequences of a proposed course. This might include a warning of the possibility of the exercise of reserve powers. Such a right would be exercised only in exceptional circumstances.

It is important to bear in mind that the Governor is not concerned with the wisdom of a proposal or issues of politics or public policy. These are matters for the elected government. Similarly, it is for the courts to determine the validity or otherwise of an exercise of power. The Governor’s concern is to be satisfied that the proposal falls within the Constitution and accords with the rule of law and the practices and conventions of good government.
Reserve powers

The Governor has reserve powers that can be exercised notwithstanding the absence of, or despite, Ministerial advice. The reserve powers are very limited in nature and exist to ensure that Victoria’s system of government operates within the accepted democratic and constitutional framework. They can, however, only be exercised in very exceptional circumstances.

That time is now. These are exceptional circumstances. Without the Governor's royal assent, the Bill will not be enacted into law.

Victoria has recorded 905 new local COVID-19 cases and four deaths.
Key points:

The death toll for the current Delta outbreak in Victoria now stands at 411
There are 394 people in hospital with COVID-19, including 75 in intensive care
Victoria has fully vaccinated 87 per cent of its 12+ population

There are now 17,302 active cases of the virus, and 411 people have died during the current Delta outbreak in the state.

There are 394 people in hospital in Victoria with COVID-19, of whom 75 are in intensive care and 46 are on a ventilator.

The health department said a further 72 people are in intensive care but their COVID-19 infections are no longer active.

The new cases were identified from 64,218 test results received yesterday.

There were 8,498 doses of vaccine administered at state-run sites yesterday, and more vaccinations at GP clinics and other venues.

Victoria has now fully vaccinated 87 per cent of its 12+ population.

Restrictions are set to ease considerably when Victoria has fully vaccinated 90 per cent of its 12+ population, which is due to happen by November 24.

When the 90 per cent vaccination threshold is reached, there will be no limits on outdoor or indoor gatherings, masks will not be required except in high-risk settings, and on-site work can resume for anyone fully vaccinated.

Events may also proceed with no attendee caps or density limits for the fully vaccinated.

Victoria has recorded 860 new COVID-19 cases and five deaths, as the number of hospitalised COVID cases drops to the lowest number since late September.

Today's new case figure is the lowest recorded in Victoria since September 26
Victoria's upper house will debate the government's pandemic bill this week

Today's daily case count is the lowest recorded in Victoria since September 26, when the state recorded 845 cases.

The seven-day average for daily cases is now 1,069, and has been dropping in the past few days after peaking at near 2,000 in mid-October.

There are now 17,518 active cases of the virus in Victoria, and 416 people have died in the state during the current Delta outbreak.

There are now 14,131 active cases of the virus in Victoria, and 424 people have died in the state during the current Delta outbreak.

There are 394 people in hospital with COVID-19, of whom 72 are in intensive care and 44 are on a ventilator.

The health department said a further 61 people are in intensive care but their COVID-19 infections are no longer considered active.

The new cases were identified from 53,527 test results received yesterday.

There were 7,191 doses of vaccine administered at state-run sites yesterday, as well as more vaccinations at GP clinics and other venues.

Victoria has recorded 827 new COVID-19 cases and 19 deaths as it sits just below its 90 per cent vaccination threshold.

The cases were recorded from 48,427 test results processed on Monday, taking the state's total active cases to 9,420.

The death toll from the current Delta outbreak is now 479.

The latest cases have taken the seven-day average for daily infections to 1,082.

Victoria has recorded 1,196 new local COVID-19 cases and three deaths, as the number of hospitalised patients continues to fall.
Key points:

There are 284 people in hospital, the lowest number in two months
The state is still yet to officially hit its 90 per cent vaccination target
A vaccination expert has suggested Victoria's vaccine mandates may not be justifiable after the end of the year

There are now 9,774 active cases of the virus in Victoria, and 482 people have died during the state's current Delta outbreak.

There are 284 people in hospital with COVID-19, of whom 52 are in intensive care and 29 are on a ventilator.

The health department said a further 53 people were in intensive care but their COVID-19 infections were no longer considered active.

It is the lowest number of hospitalised patients with COVID-19 since September 23.
