Who owns the "Aboriginal" flag ?

Post by Juliar » Wed Aug 26, 2020 7:47 am

The never ending farce about the "Aboriginal" flag continues. It is rumored to be a copy of another flag.

Government must not buy Aboriginal flag 'because there is already one national flag'
20/08/2020

Sky News host Peta Credlin says Australia should be very careful about change surrounding calls for the federal government to purchase the Aboriginal flag amid growing copyright concerns.

Since 1997 the Aboriginal Flag has belonged to Aboriginal artist Harold Thomas, who has granted permission for the flag to be flown, but any commercial use requires permission.

“Inevitably, there are now calls for the federal government to buy the copyright to the flag so that it can be freely flown … and used by anyone which isn’t (already the case) because the artist – the indigenous artist – has commercialised his copyright,” Ms Credlin said.

“Should taxpayers be forking out to buy the copyright for a flag that an indigenous man has commercialised?

“Wouldn't that put more pressure on governments, to fly the Aboriginal Flag, jointly with the National Flag, everywhere, all the time?

“I've no issue with the aboriginal flag flying high on days of special indigenous significance, like Sorry Day, or NAIDOC week but not all the time, because I'm strongly of the view that there's only one flag that's supposed to represent all Australians.”

Anzac Day: Aboriginal flag row in Western Australia
Published 21 February

A decision to ban the Aboriginal flag and other forms of recognition from Anzac Day services in Western Australia (WA) has sparked widespread backlash.

Each year, solemn ceremonies are held on 25 April in Australia and New Zealand to commemorate veterans and soldiers.
But a veterans' organisation said it would no longer allow Aboriginal displays at its services in the state.
It added that all content, except the NZ anthem, must be in English.
The Returned Service League (RSL) has previously been criticised for ignoring and diminishing the service of Aboriginal soldiers in World War One and other conflicts.
The decision follows a move last year where the Ode of Remembrance was read at a ceremony in an Aboriginal language, the Australian Broadcasting Corporation reported.
Critics, among them indigenous and non-indigenous lawmakers, have called the move "offensive" and demanded it be reversed.

Why not just design and make a new flag as the current one is pretty bland ?

WAM Clothing Sends Copyright Cease And Desist To The Sun

In an unusual move, WAM Clothing, the non-indigenous business that owns the rights to the aboriginal flag, has sent a Cease and Desist letter to the Sun for breach of exclusive licence.

Designed in 1971 by Harold Thomas, an Aboriginal artist, the Sun is represented by the yellow circle in the centre of the flag, whilst the red represents the red earth of central Australia and the black the Aboriginal people themselves.

Embraced by indigenous Australians, the flag was recognised as a ‘Flag of Australia’ in 1995.

In 1997 the Federal Court agreed that the flag has protection under Australian copyright law, allowing Thomas to licence the design. In 2018, the flag was licensed to WAM Clothing for use on articles of clothing, a right which has seen it issue Cease and Desist orders to several businesses, many of which were owned by Aboriginals.

This year the AFL declined to enter into an agreement with WAM Clothing to feature the Aboriginal Flag on it’s jerseys during the Sir Doug Nicholls Indigenous Round.

Instead, spectators were encouraged to celebrate indigenous Australians by bringing their own Aboriginal flags.

A spokesperson from Gouge & Vamoose, the legal team representing WAM Clothing, said the Sun’s behaviour was outrageous and totally inexcusable.

“The Sun is flagrantly using a component of a licenced design for it’s own purposes without seeking permission or paying any form of licencing fees whatsoever” said attorney Bradley Cufflink.

“Our client has purchased exclusive use of the Aboriginal Flag design for use on clothing; however at any point any person in any clothing can walk outside and immediately have the Sun on their own clothing without paying a licencing fee to the rightful copyright owners. We are calling on the Sun to immediately cease this disgraceful behaviour and respect Australian copyright law.”

“We are also seeking justice for our client in the form of damages for the years 2018, 2019 and 2020. Furthermore, we are also applying for the Court to retroactively apply the damages for the previous 4.6 billion years since the Sun was formed.”

Although a date in 2021 has been set for the hearing, it is hoped the Sun will not attend, due to the repercussions for life on Earth.

So far the Sun has been served 3 times, but it is unclear how successful the services were as the Process Servers were not able to be located afterwards.

The Sun was unavailable for comment.

Smoke Welcoming thingies? What a lot of crap. The original abbos ran around in the nuddy and didn't put bird poo on their faces to show they were "warriors". They have copied all that from the Maori. Abbos haven't got an original thought in their small brains. We are ALL AUSSIES and should be treated the same. Did they ever remove the Aboriginal "Embassy"? What an eyesore that was! :rofl
