The Act contains three major sections.

The first authorizes the President to require businesses to sign contracts or fulfill orders deemed necessary for national defense.

The second authorizes the President to establish mechanisms (such as regulations, orders or agencies) to allocate materials, services and facilities to promote national defense.

The third section authorizes the President to control the civilian economy so that scarce and/or critical materials necessary to the national defense effort are available for defense needs.[3]

The Act also authorizes the President to requisition property, force industry to expand production and the supply of basic resources, impose wage and price controls, settle labor disputes, control consumer and real estate credit, establish contractual priorities, and allocate raw materials towards national defense.[3]

At Wednesday's White House press briefing, President Trump said he would invoke the Defense Production Act of 1950 in response to the COVID-19 coronavirus pandemic, which gives the federal government broad powers to enlist private companies to help with national crises.

The Defense Production Act of 1950, enacted at the outset of the Korean War, allows the federal government to compel companies through loans, loan guarantees, purchases and purchase commitments to prioritize and expedite development of supplies and resources to support national defense.

In this case, the Defense Production Act will be used to accelerate the development of medical masks, ventilators and other healthcare supplies as cases of the coronavirus tick up in the country, according to a count by Johns Hopkins University.

According to a Reuters report, the Trump administration mulled using the act last month, around the time the president was attempting to minimize the effects of the coronavirus.

Testifying before Congress at the end of February, Health and Human Services Secretary Alex Azar stated that up to 300 million masks could be needed for U.S. healthcare workers, and the current national stockpile sits at 30 million; making the shortage more difficult, the majority of the medical supplies are manufactured in China, according to the New York Times.

An instance where the Defense Production Act was used domestically in the past occurred in January 2001, by President Bill Clinton and then President George W. Bush to supply California utilities with emergency electric power and natural gas amidst electric blackouts, according to a Congressional Research Service report.

It's a stunning reversal President Donald Trump would like Americans to forget.
Only days after dismissing the coronavirus threat as a distraction, he's now assumed the title of a resolute war time president fighting an "invisible enemy" while promising to rally the nation behind him in pursuit of "total victory."
Trump's new posture is in response to a crisis that is worsening by the hour and appears to be partly designed to cover up the administration's failures in distributing testing kits that have might help authorities slow the virus' advance.

And it is already being undermined by his own actions. He's casting doubt over whether he will actually implement a move to invoke the Defense Production Act -- that he signed on Wednesday and that gives him authority to order industry to work towards homeland defense and national goals. In this case, it could speed the production of badly needed ventilators, masks and other supplies for hospital workers.
And an announcement that hospital ships will be deployed to New York and a forthcoming West Coast destination is going to happen more slowly than it first appeared. Defense Secretary Mark Esper told CNN Wednesday that it will be several weeks before the vessels are ready.

They argue that under current preparations, Australia will be "in a worse position than Italy is currently in".
Italian doctors are reporting they do not have the necessary ventilators and other resources needed to save critically ill COVID-19 patients, and they have been forced to make the wrenching choice between patients who can be helped and those who will be refused the treatment necessary to save their lives.

Dr Holley said while a rapid surge in case would present a "challenge", health authorities could boost the capacity of intensive care units "quite rapidly" by deferring elective surgery to free up beds and buying extra equipment, including ventilators, to convert ward beds into ICU beds.

"We could have a 30 per cent surge based exclusively on additional physical beds in ICU," he said. "We could do that tomorrow."

Professor Murphy has said the federal health department is preparing to respond to a number of modelled scenarios, including a "worst case" outcome where "some millions of people [are] infected over a period of several weeks", including working to build the capacity of critical care beds.

Australia's national COVID-19 pandemic plan outlines hospital surge capacity measures including higher patient-to-nurse ratios in ICU units, where a patient on a ventilator would normally have a dedicated intensive care nurse monitoring their vital signs.

Dr Holley said a low-cost ventilator sold for between $5000 and $10,000, while top-of-the-line models sold for $50,000.

The Queensland health department has so far acquired an additional 110 ventilators. "Our hospitals are prepared to triple emergency department capacity and double intensive care unit capacity, when required," a spokeswoman said.

NSW Health, which has more than 1000 ICU beds, declined to say how many extra ventilators the state was buying. A spokeswoman said the department was "planning for a potential increase in presentations of people with respiratory illness" and working to "maximise available critical care resources", including "monitoring intensive care bed availability, staffing and availability of critical infrastructure, such as ventilators".

Dr Holley said the new guidelines for intensive care doctors and nurses would detail how to best test and treat patients with the coronavirus, including preventing its spread within the hospital.
