Phelps never resigned as a councillor on Sydney Council, so under section 44 of the Australian constitution is not (and was not) eligible to sit in parliament. That means her medical evacuation for refugees/asylum seekers legislation is null in void .. not legal.
If Donald Trump is so close to the Ruskis, why couldn't he get Vladimir Putin to put novichok in Xi Jjinping's lipstick?

No case has been brought against anyone who was a sitting councillor, Yogi, so I am unsure why you believe that. Many councillors are non-paying positions. Section 44 (iv) refers to an "office of profit" in the traditional sense of a position carrying an entitlement to any form of financial benefit, including salary. As with the reference to "pension", part of the intention is prevent the Executive from corrupting a member by offering such a position. However, the provision has been interpreted to prevent any individual who is already in state employment from standing for parliament, even if they would have had to resign from that position if elected. Unpaid councillors are not in an "office of profit."
