Cultural Defence for Murder

A Sydney man who said he bit and shook his baby daughter for cultural reasons has been refused bail on a charge of murdering the two-month-old girl.

The 35-year-old, who cannot be identified and who was on a bridging visa at the time, has been charged with murdering his daughter, who died of catastrophic brain injury on November 13, 2015.


In the NSW Supreme Court on Tuesday, Justice Natalie Adams refused him bail saying at the very least the crown case for manslaughter was strong.

She also noted he was now in protection after being stabbed in jail following the naming of him in a media report.

The man has pleaded not guilty to murder as well as to domestic violence-related charges.

He allegedly told police he had bitten and shaken the child "for cultural reasons".

His lawyer told the court the kissing, biting and shaking was done in a "misguided" attempt to assist the baby.

Referring to the crown case, the judge said a friend noticed bruising on the baby's cheek days before her death.

Why do we continue to protect people like this? It's a bit hard to follow cases where names are withheld and these animals are under protection. We should be able to follow cases like this to to see what 'justice' is finally dished out, if any. He bit the baby and shook it so hard as to cause "catastrophic brain injuries'.

He was on a bridging visa so he should be sent back to wherever it is he came from. We do not need this sort of 'cultural assistance' in this country.

Agree, I am generally not in favor of identity suppression. I don't see this case as exceptional.

I am generally in favor of identity suppression. It is done to protect the identity of the victim.
I see this case as exceptional.

There should be no suppression particularly when the victim is dead . Name and shame.

I am sure there are many people who want to know how this case concludes and what happens to this 'cultural' animal.
He is due to be arraigned in the Supreme Court on April 6
If I remember I will check the Supreme Court list for that day.

Yes Black Orchid- yesterday I saved Justice Adams' Bail Hearing list so I can compare it with the Arraignments list on April 6.

In the NSW Supreme Court on Friday, the 35-year-old, who cannot be identified, pleaded not guilty to murdering her on November 17, 2015, and to assaulting her occasioning actual bodily harm on November 13.

Justice Elizabeth Fullerton listed the estimated three-week trial to start on October 15.

The man unsuccessfully applied for bail in the Supreme court last month.

He has pleaded guilty, put him to work for the rest of his natural life now
