Almost two years after the Heydon royal commission report was handed down, tough penalties will apply to dodgy union-employer agreements.
Unions and bosses face hefty fines and jail terms from Monday for giving, receiving or soliciting a "corrupting benefit" and must disclose more details about enterprise agreements.
The laws, which emerged from the Heydon royal commission, were met with a mixed response from industry and unions when first put to parliament.
Labor argued that while the party had zero tolerance for corruption, the laws subject employers, workers and unions to serious penalties for conduct that is not corrupt, dishonest or improper.
Employment Minister Michaelia Cash said the reforms would ensure workers came first.
"For too long some union officials have been paid private kickbacks they used for personal expenses, to bolster union coffers or bolster their status and power, all at the expense of workers. From Monday, such corrupting payments will be illegal," she said.
The minister gave the example of a building company which spent $32,000 hiring a staff member to act as former union secretary Bill Shorten's campaign manager in the run-up to the 2007 election.
While such a payment was lawful at that time, it would be illegal under the new provisions.
Australian Industry Group chief Innes Willox said some unions had insisted upon enterprise agreements requiring particular income protection insurance products be purchased by the employer.
That's despite the same insurance product being available for one-fifth of the cost of those insisted upon by unions.
"This highlights that unions and the insurance companies that they are aligned with are reaping huge, inappropriate financial rewards at the expense of employers, employees and consumers," Mr Willox said.
Under the new laws such financial benefits from any enterprise agreement will need to be disclosed or fines of up to $63,000 will apply.
The Heydon royal commission identified a number of examples where employers agreed to certain payments to unions or union officials in order to achieve industrial peace or give a company an edge over its competitors.
Such "corrupting benefits" will now attract a jail term of up to 10 years and maximum $1.05 million fine. A body corporate may be fined $5.25 million.
As well, an individual who offers, gives, receives or solicits a cash and in-kind payment may be jailed for up to two years and fined up to $105 000. A body corporate may be fined up to $525 000.
The deduction of union fees from wages, token gifts or event invitations and modest payments for travel expenses are not caught up in the laws.
The Business Council of Australia has also welcomed the new laws as instilling greater confidence in the integrity of the workplace relations system.
Registered Organisations Commissioner Mark Bielecki said his organisation would help unions and employers learn about their requirements under the new laws.
"We are working with other agencies that will be directly responsible for these provisions, such as the Fair Work Ombudsman, the Australian Building and Construction Commission and the police," he said.

The reality is that the RC was a failure. NOT ONE SINGLE CONVICTION resulted from it. Everything else is just the usual anti union crowd pretending it was a success.
