Tribunal overturns decision to deport sex creep taxi driver Jagdeep Singh again.

ADMINISTRATIVE Appeals Tribunal boss John Logan has thwarted Immigration Minister Peter Dutton by again saving sex creep Jagdeep Singh from deportation — but the battle is not over.

The AAT acting president has overturned a ministerial decision to kick the taxi driver out of Australia.

Justice Logan granted Singh a bridging visa last ­Friday.

But Mr Dutton showed he wasn’t prepared to accept that, and a delegate for the minister has since cancelled the visa Justice Logan gave to Singh.

The Herald Sun understands Singh is now back in detention awaiting deportation.

This bizarre to-ing and fro-ing over Singh is evidence of a serious gulf between the AAT and Mr Dutton.

The Herald Sun last month revealed a delegate for Mr Dutton first cancelled Indian-born Singh’s visa in September last year after the taxi driver pleaded guilty to indecently assaulting a female passenger.

Senior AAT member Miriam Holmes overturned that decision and allowed Singh to remain in Australia.


She did so despite making a formal finding that Singh committed “a significant sexual offence involving a vulnerable member of the public whilst the applicant was engaged as a taxi driver”.

That prompted Mr Dutton to flex his muscles.

He used his power to personally overrule the AAT and order that Singh be sent back to India. The Herald Sun revealed on May 31 that Australian Border Force officers had grabbed Singh at his Lalor home and put him in detention prior to him being deported.

As the Herald Sun reveals today, Justice Logan referred to Mr Dutton’s personal involvement in the Singh case in his decision to grant Singh a visa — a decision challenged yet again by Mr Dutton.

Justice Logan stressed the need for AAT members not to be swayed by comments made by ministers or their delegates.

“Certain features of the conduct of the minister’s department in relation to this review cannot pass unremarked,” he said in his written decision.


“Any member who allowed himself or herself to be ­persuaded as to an outcome by partisan or political rhetoric by a minister, or any other administrator, or the popular press, would be unworthy of the trust and confidence placed in him or her.

“For those members who do not enjoy the same security of tenure as judges, that may call at times for singular moral courage and depth of ­character.”

Who appointed these idiots? They certainly do not consider public safety to be a consideration let alone a priority.

Why can't we dump them all? Justice Logan spouts off about the Minister being untrustworthy with no moral courage nor depth of character yet constantly releases violent criminals on to the unsuspecting public?

Once the saying was "Only in America" but sadly it should now be "ONLY IN AUSTRALIA". I cannot believe we have sunk so low as to allow the luvvies warped mindset dictate and diminish our values and safety.

It's a disgrace found only in Australia. We are an embarrassment on the world stage.

this all costs a fortune....its time we were told how much a case like this costs us the tax payers..

of course he should be deported...women have a right to be protected

RAPE is a serious crime.. or isnt it when it comes to a tribunal?... :mad

I bet it costs a fortune keeping them in Villawood alone..
probably more than a prisoner in Goulburn

I think the public are entitled to know the true bill for every cent that is spent on immigrants including housing, special force squads, de-radicalisation programs, legal costs, watching them, benefits, new jails, Tribunals, compensation etc etc etc and the list goes on and on and on.

Taking money from pensioners while ridiculous amounts are spent in these areas is not only Un-Australian it amounts to treason and should be treated as such.

These halfwits are at it again.
Immigration Minister Peter Dutton insists dual nationals who commit serious crimes in Australia will be deported despite a tribunal ruling a Brazilian armed robber could stay.

Pedro Fernandes, 27, was jailed for four years in 2013 for an armed robbery which saw him and an accomplice force a manager at Sydney's Randwick Golf Club to open a safe before making off with its contents.

Upon his release from prison, Fernandes' visa was cancelled by delegates of the minister, first in June and later in December 2017.

However, the Administrative Appeals Tribunal's deputy president James Constance overturned that decision, despite admitting in his written summary that Fernandes' conduct involved 'violent offending, dishonesty, domestic violence, drug use and an alcohol-related driving offence'.

Unbelievable. Who is this James Constance? When radio 3AW spoke out against the overturning of Dutton's decision Constance said their opinion did not reflect the views of the Australian people. He thinks most Australians want these violent criminals to stay here and have a tea party. What planet is this fool from?
