Gable Tostee to face trial again??

Gable Tostee has taken to social media to dismiss as 'nonsensical' suggestions of him being recharged over New Zealander Warriena Wright's balcony death.

The Queensland Coroner has reopened investigations into Wright's death after Tostee was acquitted last October of her murder or manslaughter.

Coroner James McDougall is yet to determine if an inquest will be held.

He has the power to recommend a fresh prosecution against Tostee, depending on the outcome of his investigation and if any new or compelling evidence emerges.

Tostee, using his adopted alias Eric Thomas, joined the Gable Tostee Trial Discussion group on Facebook earlier today to comment on the development.

Responding to a question from a group member about how long a decision on an inquest might take, Tostee said he had been told by his lawyer it would be six months.

"It's extremely unlikely there would be one, since all the investigation and causation has already been determined," he posted.

"It would also be extremely difficult to justify spending the tax dollars on something that would essentially be redundant.

"It's also nonsensical to suggest there may be further charges such as deprivation of liberty, as the murder charge particularised the act of locking the deceased outside (on his balcony) as one of the elements of the charge.

"Since I was found not guilty, a deprivation of liberty charge should fail for the exact reason that I was effectively already acquitted of it."

IMHO....this case was dreadfully mismanaged by the Prosecution (in typical QLD manner).

My hope is that an inquest results in a fresh trial because Tostee needs to be in prison.

I would like to see that to be honest...

he should never have been charged with murder....but for sure he shouldnt have got away free..

he did leave the scene of a "crime" a person did die.he was missing for hours eating pizza among other things.
called his dad but not the police or even a hospital he was stunningly untouchable...no one to contradict a word he said.
even her screaming NO 30 times wasnt an issue..

but murder.. nup...

but something!

yeah that should make a diff....

he will be very disappointed if this gets off the ground..and he wont have nef to beat to death for daring to look at Websleuths...

where he couldnt find anyone to agree with him... so of course the place was crap wasnt it...lolololol

QUEENSLAND’S Coroner’s Office says it will liaise with Gold Coast balcony death victim Warriena Wright’s New Zealand-based family before deciding whether to hold an inquest into her death.

It was revealed last week that the Coroner had reopened investigations into the death of Ms Wright, who plunged from her Tinder date Gable Tostee’s 14th-floor Surfers Paradise high-rise balcony in August 2014. Mr Tostee was acquitted of her murder and manslaughter after a two-week Supreme Court trial in October this year.

Police immediately referred the case back to the Coroner, who can make recommendations such as criminal charges and suggested measures to ­improve public safety.

Mr Tostee took to social media this week to dismiss the investigation as a non-event.

An inquest is a court hearing conducted by the coroner to gather more information about the cause and circumstances of a death. Coroners can also make recommendations about matters connected with the death, including matters related to public health and safety or the administration of justice. These recommendations are aimed at preventing similar deaths in the future. Recommendations can only be made if an inquest is held.

An inquest is not a trial and there is no jury. It is not about deciding whether a person is guilty of an offence or civilly liable. Inquests are less formal than conventional court hearings and the coroner can inform themselves in any way they consider appropriate. Although the rules of evidence do not apply, the coroner must ensure that the proceedings are conducted fairly.

The coroner will hear evidence on oath from people who have information about the death. These witnesses can include police officers, family members, doctors, other experts, eye witnesses or members of the public.

The inquest is usually held in the closest magistrates court to where the death occurred.

When is an inquest held?

Very few coronial investigations proceed to inquest. An inquest must be held if:

the death is a death in custody
the death occurred while the person was in care and there are issues about the care being provided
the death occurred as a result of police operations unless the coroner considers the circumstances do not require an inquest
the Attorney-General directs that an inquest be held
the state coroner orders an inquest to be held
the District Court upholds an appeal against a coroner’s decision not to hold an inquest.

In other cases, a coroner may decide to hold an inquest if it is in the public interest to do so. In deciding this, the coroner may consider whether there is significant doubt about the cause and circumstances of death or whether holding an inquest may help to prevent future deaths or uncover systemic issues which affect public health and safety.

well its a start I believe the circumstances of her death needs investigating..

he didnt murder her thats for sure...but he sure didnt do the right thing by her either..

it wont bring her back but like leaving the scene of a car accident that takes a life...

there are consequences or there should be.

If the inquest proceeds (and I think it will/should), will this Coroner make recommendations as regards :

1) criminal charges and

2) improving public safety?

IMO....

1) Probably not

2) Probably

Having said that.....I'd love to see the Coroner send this matter back to the DPP.
