Disgraced former NSW Labor minister Eddie Obeid has been sentenced to five years' jail, with a minimum non-parole period of three years.

The former powerbroker was found guilty in June of misconduct in public office.

The conviction relates to Obeid's failure to disclose his family's financial interests in cafe leases at Sydney's Circular Quay, while lobbying a senior bureaucrat in 2007 when he was a member of the NSW Upper House.

He will be eligible for parole in December 2019.

Supreme Court Justice Robert Beech-Jones described Obeid's crime as "very serious", as he detailed the reasons behind his sentencing decision.

He said he did not agree with the defence team's argument that Obeid's crime was at the lowest end of seriousness.

Justice Beech-Jones said Obeid was found to have abused public trust "to advance the financial interests of himself or at least his family".

"He intentionally abused the public trust proposed in him as a member of the legislative council of NSW," he said.

Justice Beech-Jones said Obeid "duped" NSW Marine Authority bureaucrat Steven Dunn by lobbying him without disclosing family's financial interests.

He said the lobbying "was not undertaken because [Obeid] in any way believed it was in the interests of the public or the electorate".

Jailed former Labor powerbroker Eddie Obeid will remain behind bars in Silverwater prison over Christmas after his bail application was denied.

The 75-year-old former NSW MP appeared via video link dressed in loose-fitting prison greens and remained impassive this morning as he watched his counsel, Guy Reynolds SC, argue there were “special and exceptional circumstances” which should allow Obeid to leave jail and return home pending an appeal.

Obeid, who was found guilty and sentenced to a maximum five-year jail term for lobbying a maritime official in 2006 to secure favourable outcomes on cafe leases located at Circular Quay, watched this morning from a small room in the Metropolitan Remand and Reception Centre, the maximum security facility for males at Silverwater. He has been housed at the correctional complex for the last five days.

Obeid’s counsel Guy Reynolds SC said there were “strong grounds” to argue there has been a miscarriage of justice in convicting and sentencing his client.

He said a “host of problems” had arisen regarding the wording and definition of the duties which should be upheld by Australian politicians.

“We submit with all due respect … it gives rise to quite absurd consequences given overbreadth and capacity to cover manifold activities by many MPs throughout their day to day activities,” said Mr Reynolds.

“Suggesting hypothetically the Prime Minister is doing something because he has some indirect financial interest, (which has a) knock on effect, that’s the sort of thing which leads to criticism in the media and accountability in the parliament, but it’s not the stuff of legal duties.”

However, Chief Justice Tom Bathurst said the court of criminal appeal had determined there were “no special or exceptional circumstances to warrant bail”.

He said while the grounds of appeal outlined by Mr Reynolds were arguable, they should have been raised “before the trial judge”, Justice Robert Beech-Jones.

“No explanation has been given as to the reason they have not,” he said.

Obeid launched the legal action to secure his release from prison just days after he was sentenced last Thursday.

He had previously applied for bail immediately after the sentence, but it was denied by Justice Beech-Jones, who said mitigating factors such as his close-knit family, age and ill health were of “no real assistance” to the man’s plea for no jail time.

During sentencing, Judge Robert Beech-Jones said “no penalty other than imprisonment” was appropriate for the former political heavyweight.

Mr Obeid became the first state government minister to be jailed for corruption in public office since Rex “Buckets” Jackson in 1987.

He will next year face another criminal trial, this time over an allegedly corrupt $30 million coal deal at Mount Penny near Mudgee.

His appeal of the conviction and sentence for the Circular Quay-related misconduct offences will be heard on March 15 next year.

I remember Rex from when I was a kid. Grew up in an ALP family and Rex on occasion visited our house (as did Les Johnson & Robert Tickner - Fed MPs). Rex was very anti-copper, then became Minister for Police and Corrective Services, received abuse from inmates on a gaol tour and became anti-crim. He initiated a host of new draconian gaol regulations like 'No posters on cell walls' ect, and the crims rioted.

Rex loved to punt on the horses, and it was pretty common knowledge that if you wanted to see Rex, you had to be at the track on Wednesday. The gaols were being over crowded so Wran gave him the OK to let crims out "on licence". Which Rex took payment for in brown paper bags. When the media got wind of it Wran & Co denied all knowledge of it, and Rex wound up in one of his own gaols -Berrima (protection gaol) ... Low security too. When I was in gaol I was on a transport that went to Berrima, the front gates were wide open and looking out the window I could see the inmates walking around town in their greens.
When Rex got out he sold ice creams from a Mr Whippy van.

Obeid should be used as an example and his parliamentary pension withdrawn immediately. His bank accounts should be frozen and those people who were ripped off should be compensated. Of course this won't happen, because half our politicians are corrupt and don't want the same thing to happen to them if they're caught.
