Yes, defacto relationships, which include two people of the opposite sex OR a same sex couple. Here is the latest regarding Division of Property when a defacto relationship breaks down.

I asked my Solicitor way back (about 1998) when I was making a new Will, what the position was regarding property etc, should I enter into a defacto relationship. She told me that the division of property and assets would be the same as if you were married, should the relationship break up. The difference was that division of property law starts as soon as you sign the marriage certificate, whereas with a defacto relationship, you have to be cohabiting for 2 years.
Her advice was "it works both ways, so you can either pick someone with more than you have, or kick them out before the 2 years is up."
This was ACT Law and it may have been different in other States, as mentioned in the above link I posted.
I also asked her about pre-nuptials and at that stage she said they weren't worth the paper they were written on. I think that has since changed.
PS I wasn't considering living with anybody, just thought I would get some free legal advice while there.

What the hell is an Intersex person? I had to look it up. Yikes! I wonder, are there enough Intersex people around to be affected by same sex marriage?
