As far as "beyond reasonable doubt" goes the Jury sought the Judge's advice on that as well as Manslaughter and a couple of other things. I was lurking on a Forum where members were actually in Court and sending messages throughout the entire trial. Plus there were Twitter feeds from various media people in Court. I was also watching the proceedings while the Jury was deliberating for the 4 days before they came to a verdict. Oh and on that Forum where were several people who were Lawyers, Doctors and other professions that know about such things who were also giving their take on matters as they arose. Very interesting.
I believe I did read in the MSM that the under the fingernail DNA was said to be "some other person" (and not Allison, obviously) but they did NOT say that it was NOT GBC's. I knew I'd seen it somewhere and from recollection it did say it was not his DNA.
There was a list of "evidence" that the Defence team wouldn't allow the Jury to hear and some of that was what the Forensic Pathologist (Dr Nathan Milne) had determined, including possible death by subdural haemorrhage. I imagine that the DNA report regarding the matter under the fingernails has NOT been released for public scrutiny. Guess whose DNA it might have been! If it was his, it would have intrinsically relevant and absolutely admissible as direct evidence relevant to the marks on his face. There is no reference to the DNA Report in that Judgement you have already linked concerning matters to be and not to be shown to the Jury, or heard by them. I agree with the suppression of the subdural haemorrhage speculation, as that is exactly what it was ~ mere speculation.
GBC obviously had not told his Defence team the truth or part thereof (or confessed) so they had to do their best with what they had to defend him on Legal Aid. Given how the defence was run, there is no way he confessed to his Lawyers. That is just out of the question, so get that idea out of your head.
In any event, GBC is GUILTY as charged and will spend the next 15 years in a small cell. Perhaps he will study to the a solicitor while he is there. It's only a 3 year course. He won't be able to practise though, being a convicted crim and all. It is more than a three year course ~ five years in the late 60s.
Now, aussie, is there anything else you would like me to do for you? Cup of tea perhaps, sandwich, beer? I could do with a back scratch and it is your turn. Nah.
Great to know that you now know how to use COLOR plus cut and paste. CONGRATULATIONS!Aussie wrote:Neferti~ wrote:How the fuck would I know? You said:Aussie wrote: Where is the fingernail DNA Report?

http://www.couriermail.com.au/news/quee ... 8225592339Police allege Gable Tostee assaulted Warriena Wright before she plunged to her death from his 14th floor apartment on the Gold Coast
‘NO, no, no … I just want to go home.”
These were allegedly the last words of terrified Kiwi tourist Warriena “Rrie” Wright as she tried to flee Gold Coast playboy Gable Tostee.
The Sunday Mail has obtained exclusive details of the police case against Tostee, who faced court yesterday charged with murdering Ms Wright only hours after they met on controversial dating site Tinder.
DETAILS: Flawed hermit caught in fatal web of sex hook-ups
BALCONY PLUNGE: Victim’s last moments caught on tape
Police will allege Ms Wright, 26, had been assaulted, was “in fear of her life” and trying to escape when she plunged to her death from the balcony of Tostee’s 14th floor apartment in the Avalon tower last Friday week.
Audio recordings of her last moments, believed to have been extracted by police technical experts from mobile phones found in a car in the building’s basement were the breakthrough detectives needed to arrest Tostee on Friday after an intensive week-long investigation.
Police will be relying on High Court findings in other cases of people fleeing in fear and dying to make the murder charge stick.
