ACT introduces Marriage Equality Bill into Legislative Assembly.

Again! They tried it when Howard as PM, if I remember correctly. The ACT Assembly obviously doesn't understand Section 51 of the Australian Constitution.

I happen to live here. It's a Labor town, due to the Public Service and Academic population of beards and sandal wearers.

However, the ACT Legislative Assembly can do whatever they like about pot holes, and round abouts but Section 51 of the Australian Constitution states that Marriage is a Federal matter.

For those who do NOT know about Section 51 .... here it is:

Depending on ACT's reasoning for wanting to grant all of their citizens the same rights and protects under law, I could make one hell of an argument that Chapter V, Section 116 could be used as a justification as most arguments against allowing gays to marry same as straights are based on religious belief.

If your basis for restricting gays from having the same rights as straights is an arbitrary religious standard then you're making a de facto establishment of religion, which is forbidden under Chapter V, Section 116. The exact same argument was made successfully here, as the religious underpinning for the Defense of Marriage Act and state level marriage laws are all based on religious belief, violating the Establishment Clause of the First Amendment of the Bill of Rights of the US Constitution. I'm pretty sure if anyone in ACT has even half a brain they're hoping that your Federal government attempts to strike down their state level legislation in order to force the issue to your equivalent of the our US Supreme Court. After all, that's what multiple civil rights groups did here and you guys are so damn keen on doing what we do.
