Former NRL superstar Jarryd Hayne has had his sexual assault conviction overturned and is set to face a third trial.
The Court of Criminal Appeal on Monday quashed his conviction after he last year applied to the state’s highest court.
Mr Hayne, 33, had been in jail for over nine months having been sentenced to at least three years and nine months in prison for the alleged sexual assault of a woman in her Newcastle home on NRL grand final night in 2018.
A District Court jury in March last year found the former Dally M winner guilty of two counts of sexual assault, accepting the woman’s version of events that he performed digital and oral sex on her without her consent.
He was subsequently sentenced by Judge Helen Syme to five years and nine months jail, with a non-parole period of three years and eight months.
He launched an appeal against his conviction claiming the NSW District Court jury was given flawed directions and there were inconsistencies in the evidence.
His barrister Tim Game argued that the jury was given directions that were “flawed in almost every possible way” before they were sent to deliberate.
According to Hayne’s barrister, Judge Syme used words like “might” and “may” when she should have used “beyond a reasonable doubt”.
Mr Game also argued before the Court of Appeal that the woman’s words in a text sent to a friend did not accord with her evidence that she repeatedly said “no” and “stop”.
The Court of Appeal of Monday quashed his convictions and ordered him to face a fresh trial, with the matter listed to be mention in the District Court on Thursday.

I happen to agree with this ruling. I think the trial was highly suspect and that the judge sent biased messages to the jury.

Fair bit of discussion on talkback radio about it.
The suggestion is DPP may squash the third trial as has happened in past cases proposing a third trial.
Have to wait and see I guess!

A 3rd trial sounds a bit ....... unlikely.
He has a history of this sort of behaviour. The first 2 trials found him guilty.
If there was much doubt, a reasonable lawyer would have successfully defended him the 1st or 2nd time.
Wonder how much the lawyer is getting paid for this 3rd effort? $500,000 ?
Any lawyer is NOT on your side. They are NOT your friend. They do not care if you are guilty or not.
Show them the money.

Prosecutors have decided to proceed with sexual assault charges against Jarryd Hayne with the former NRL star to face a jury once again, a court has heard.
Former NRL superstar Jarryd Hayne will face a third sexual assault trial with his lawyers seeking to shift proceedings to Newcastle.
The ex-NFL convert served nine months in prison after he was found guilty of sexually assaulting a woman at her Newcastle home on NRL grand final night in 2018.
However the 34-year-old walked out of Cooma Correctional Centre last month after having his conviction quashed by the Court of Appeal.
Prosecutor Adrian Dragicevic on Friday morning told the NSW District Court that Mr Hayne would face a third trial after the Director of Public Prosecutions decided to push ahead with the charges.
“The matter is listed for arraignment so I can confirm the crown will be proceeding to a retrial,” Mr Dragicevic told the court.
The Director of Public Prosecutions was weighing up whether to proceed with the matter and on Friday morning broke the news to his lawyer Ramy Qutami that he would face a jury for a third time.
“We only just found out today about the crown’s position,” Mr Qutami told the court.
