A MAN who brutally and savagely murdered a 12-year-old girl leaving her with more than 50 injuries has “cursed the day” he was born.

The 33-year-old was sentenced to more than 37 years jail in the NSW Supreme Court at Newcastle on Monday by Justice Peter Hamill after pleading guilty to the sadistic killing of the young girl in the Hunter Valley in 2015

After initially fighting the murder charge the man wrote an “extraordinary” letter to his solicitor in November 2017, shortly before his trial was due to start, instructing them to enter a guilty plea.

In the letter, he quoted the biblical passage Jeremiah 20:14. “Cursed be the day I was born. May the day my mother bore me not be blessed,” the man wrote.

In handing down his judgment on Monday Justice Hamill said he had never seen such a letter before.

“The offender described his actions as a ‘monstrosity’ and eschewed any attempt to explain or justify it by ‘medical/clinical terminology’. He said he was ‘all things evil’,” Justice Hamill said.

“There is more of the same in this letter, the likes of which I have not previously seen.”

Despite this Justice Hamill sentenced the man, who was born in the African nation of Malawi and migrated to Australia in the early 2000s, to 37-and-a-half years jail with a non-parole period of 28 years.

“That is so because of the savage and repeated nature of the beatings over a period of days,” he said.

“The offence involved gratuitous cruelty to a young, helpless and defeated victim.

“The present case involves heinous acts of cruelty and behaviour that might well be categorised as torture.

“The photographs of the injuries to the victim are shocking. I do not have the words to describe them.”

The man, who was 31 when he killed the Year 7 student, repeatedly beat the little girl over three days between Sunday, September 20 and Tuesday, February 22, 2015.

She was eventually found dead by her mother in the early hours of the morning on the Wednesday with police arresting the man after he tried to flee the family home in the Hunter Valley.

The statement of facts reveal that over those three fateful days the man, gagged and bound the little girl, tying her hands and legs to the wooden frame of the bed repeatedly beating her with leather belts and wooden slats removed from the bed frame.

On the afternoon of the day before the little girl died she was left home alone with her killer while her mother when to East Maitland Bowling Club to play the poker machines.

She only came home when her defacto partner texted her and asked her to come home.

When she arrived home she found the stepfather wiping vomit form her daughter’s mouth.

A post-mortem examination concluded the cause of death was the result of acute blunt force trauma to the head, torso and limbs and found 50 separate injuries on the skin alone.

“Crown prosecutor told the court the pathologist told him that the mechanism of death was that the child went into shock and to adopt his expression ‘you just give up because you can't take any more’,” Justice Hamill said.

Justice Hamill said there was a history of violence carried out against the young girl by the stepfather who went to great lengths to avoid any one detecting the violent abuse.

“On one occasion in July 2015 the offender slapped CN with such force that she suffered a fractured jaw and lost a tooth.

“Throughout this period of torment the girls were not provided with medical assistance. Rather, they were kept out of school for extended periods to allow the obvious injuries they suffered to heal.”

The man will be eligible for parole in September 2043.


2 things get to me....

1/ this is all news to me....by the sound of this DOCs should have been involved.....where they???????...the silence is deafening..
2/ will the mother be charged with anything????>........even neglect would be something!

Does this creep have a name? I presume he is "coloured". The Telegraph link goes to a paywall. I will NOT subscribe to an online newspaper!

Apparently it had been happening for 4 years and even though DOCS seems to be understaffed they are consistently incompetent and children keep dying! It really is not good enough.

4 years of this so the mother obviously knew. Where was she? Playing poker machines? She most definitely needs to be charged with being an accessory, wilful neglect, second degree murder etc.

like I have already mentioned... WHERE WERE DOCS....where were the police....HOW DOES IT HAPPEN IN A NORMAL EVERY DAY SUBURB....

dont let him be thrown into jail!!!!! and thats then end of it... that isnt justice....

Was DOCS even aware of this? Four years of abuse seems a very long time without somebody in Authority hearing about it! There were apparently several other children in the family and perhaps the Mother was too scared to tell the Police. Poor little kid bashed weekly it seems ... for 4 years! Why and why didn't somebody do something? Country town ... everybody would know all about it!

The "stepfather" won't be up for Parole until 2043 or something and then he will be deported back to his place of birth ... Africa!!!

Indeed as many ask "Where was DOCS???" I also ask "Did this child's school teachers notice nothing adverse?????" No follow up on irregular attendance? This may well have shed some light on what was happening at home.

It will be alleged the mother showed "gross negligence" by knowing that the girl was being continually physically abused before she was allegedly bashed by her stepfather and put to bed in the family home at Aberglasslyn, near Newcastle in the Hunter region, last September.

To get DOCS involved, doesn't "somebody" need to report the abuse? Country town, everyone knows but nobody wants to "get involved".

That is my understanding Nef, however I'm pretty sure that teachers' reporting of "reasonable suspicion of child abuse" is mandatory. Guess they saw nothing to trigger a report??

Country town! Not sure what size it is or how many kids go to the school. Children can also be so traumatised that they do NOT report it to the Teacher. I feel so sorry for the poor little kid. How could somebody do such a thing? Men!!!!

That was my first thought too. Why haven't the teachers noticed? 4 years and they haven't noticed? Give me a break.
