Employers now wary of serving alcohol at Christmas parties.

The work Christmas party may become an alcohol-free zone after a Fair Work Commission decision in which a worker was unfairly sacked for sexual harassment and telling his bosses to "f--- off" after he was served unlimited drinks.

Leading employer groups have warned businesses of the new risks they face in serving alcohol to employees at Christmas parties following a successful unfair dismissal case,

nnes Willox, chief executive of the Australian Industry Group, said the commission decision highlighted the need for companies to minimise risks at Christmas parties and other out-of-hours work functions.

"This includes restricting the amount of alcohol served, keeping to a set time for the event, and considering how employees will get home safely," Mr Willox said.

"Employees, of course, also have responsibility to behave appropriately at work functions, and the commission's decision is of concern in this area."

The Fair Work Commission has found that employers may not be in a position to insist on standards of conduct at functions if they serve unlimited amounts of free alcohol. It found an employee who sexually harassed colleagues and told his bosses to f--- off at a Christmas party had been unfairly sacked.

Australian Federation of Employers and Industries chief executive Garry Brack said employers had been left in limbo by the Fair Work Commission's decision and its inconsistency on the issue. He said new legislation was needed to ensure the decision did not set a precedent.

"The Productivity Commission needs to look at this decision," Mr Brack said.

"I think this will be resolved by a change in legislation down the track.

Well, doesn't it make sense, that if you encourage your staff to get pissed, you can't really be surprised if some of them get a bit boisterous? Don't sack them for telling the boss to fuck off (in context, that could be as simple as a discussion about footy?).

And the sexual harassment accusations didn't even happen at the party, but afterwards, at a pub (where some of them went for afters).

Well, doesn't it make sense, that if a union prick gets pissed, you can't really be surprised if some of them want to rape? Don't sack him for raping, promote him so he can end up being the alternative PM (in context, that could be as simple as an unwanted finger?).

And the sexual harassment accusations didn't even happen when he was alternative PM but beforehand, at a union function for gullible lackeys (where raping was the culture).

Boozy work Christmas parties are a thing of the past here in the States. It all comes down to liability in a highly litigious society.
