State Prosecutor Jeff Scholtz today said it was unlikely the full truth about what happened at the murder scene would ever be known, but it was clear the men had carried out a particularly brutal attack.
He said Cockram grabbed a hooked fishing knife from Mr Everington's car and began the attack by “thrusting it in as far as it would go”.
The victim was stabbed 11 times in total and the weapon had become embedded in Mr Everington’s skull with Cockram yelling out that “it was stuck”.
Mr Scholtz said it was a savage, brutal and merciless attack and there was a community expectation in sentencing for vigilantism.
He told Justice Blaxell there was no evidence to suggest there had been any rape or child molestation.
Justice Blaxell told the accused men the victim was “completely helpless” and “defenceless” and the attack indicated their intent to kill.
He said they had blamed each other and each had different accounts of what happened.
Justice Blaxell said Mr Etherington suffered a fractured skull when the knife entered his head above the left eyebrow and penetrated his brain.

Re: Old News revisited
Murders are HUGE news in Australia, they are so relatively rare .... do they do a running count in Sydney? How many did they have in 2011? Was the "count" down from 2010?
In the good ole US of A, there is a murder every few minutes. They have even made lots of money out of Murder by creating a variety of programs on the Criminal Channel. If Oz is going to win this challenge we have to start being more American and everyone get hand guns and if you can't work out your problem, shoot the person! No death penalty in Australia. Not that has made any difference in the USA.

It's an interesting case Nef, because authorities think they may learn the true motive behind the crime, given Jeremy Cockram and Green's stories changed, this and contradicted each others statements.
This said, Mr Green has since come forward and admitted that when Cockram told him about the alleged sexual assault of his girlfriend and her young child, he didn't believe their victim "Timothy "Fritz" Everington had done it, though preceded to butcher the unemployed father of two at Serpentine river anyway.
My feeling is that WA police need to delve more deeply with respects to a motive, this and enquire into known child sex offenders, or those who may have been convicted for child porn related offences in the lead up to and after this case.
This and take a closer look at the Cockram family, brothers, sisters, in laws, mothers, fathers, ... given it's a notorious crime family, however petty in places.
Who knows, they might just find a 'link' ... some sort of connection they may have overlooked, they can only enquire I guess.

They only met the deceased the day before, .. and the detectives on duty had only had a few hours sleep before being assigned the case.

Recall Madcow from Yahoo? I think he registered a handle on Ozpolitic too...
http://www.theaustralian.com.au/news/br ... 5759475529
The individuals who prompted him to call 000 60 times was threatening a female associate/ex girlfriend of his on Yahoos message boards.
I felt really sorry for this bloke, this and still think there was much more to the story.
He wasn't well, that was blatantly obvious, though think the way Brock and co played with him was sick.

The Yahoo outcome ---- http://twitter.com/madcowmess
In the end, Madcow had the last laugh it seems, with an undisclosed sum of money.
I'm still trying to find the court papers re- Notice of proceedings in the ACT Court: RO 10/544 dated 4 August 2010, which resulted in the following.--Though, if it was a mere 'mediation' session, between Yahoos legal team and Lyle, then perhaps they may need to be applied for under FOI on a case by case basis.
http://smh.com.au/business/media-and-ma ... 15emm.html
It didn't surprise me, I warned Brock aka Carl, et al to back off, I could tell by the way Lyle Upson had almost intentionally baited them, this and made a special note of publicly ensuring his abusers knew both who he was and his state of mental health.
It smacked of a 7Y law suit... but you try telling Y7 that, they knew better.
I still have the emails I sent their reps several months before this erupted.
He's a member of the following board, this and makes a career out of being a victim, and even being spat on by housing ministers... quite a lucrative one I believe.
Last I heard he bought a houseboat.

Golly gosh, if I were the self-persecutory opportunistic suing type, I could have cashed in also... harassment, victims comp, yadda yadda yadda...

Lol, even his handle was cryptic, he lived in Turner ACT-- Turners disease aka mad Cows disease.
That will teach the Y!7 sadists to chuck rocks at the spastic bus, well and truly.
