LABOR senator Katy Gallagher has been found ineligible to sit in Parliament because she held dual citizenship when elected, the High Court has found.

The Government is now calling for the resignations of for other MPs — three Labor and Centre Alliance MP Rebekha Sharkie — who are in similar circumstances.
ator Gallagher referred herself to the High Court in December and stood aside from her ministerial responsibilities after significant pressure from the government.

British Home Office documents released by Senator Gallagher as part of the mandatory disclosure deal struck between the Turnbull government and Labor show her renunciation was only confirmed on August 16, 2016 — nine weeks after nominations closed.
Senator Gallagher’s legal team argued that she had submitted her renunciation documents and paid the fee, and that the processing of the renunciation was beyond her control.

But the High Court found her circumstances were not the same as those where foreign laws make it impossible to renounce citizenship.

“No requirement of the relevant provisions (in the British law) could be described as onerous,” the judgment reads.

GALLAGHER RESPONDS
In a statement, Ms Gallagher said she was very disappointed by the outcome of her case.

“I have spent the last 17 years of my life representing the people of the Australian Capital Territory, firstly in the ACT Legislative Assembly and more recently in the Senate,” Ms Gallagher said.

“It has been an absolute honour to hold elected office.

“I have always performed my duties to the ACT community with honesty, integrity and a desire to make Canberra and Australia a better place for all of us.

“I have always acted on the best available legal advice, which at all times, indicated that I satisfied the eligibility requirements under the Constitution. However, today the High Court has made its decision, and I respect the outcome.

I could have been a dual citizen but never bothered with it and now the laws have changed.

I think the law should be changed.

A dual citizen should not be a second class citizen.

Bobby that is what I meant. Dual citizenship is fine by me with nations who share our values.

I would object to someone in a position of power who held dual citizenship with a ME country.

I gather that the fact that they were/are dual citizens is not the problem, it is the FACT that they signed a "form" denying that they were until after the fact. They had to state that they were NOT dual citizens to run for Parliament. They either lied or were too dumb to check it and signed that document anyhow.
