Should the Ruby Princess leave Australian waters?

Gladys wants the RP gone on Sunday and her Labor opposition says those onboard are our responsibility and that Gladys is abrogating the State's international responsibility.
But the NSW opposition leader says Premier Gladys Berejiklian is abrogating the state’s international responsibilities.

“How can we possibly as a state allow that to happen?” McKay asked.

“If you are going to send that ship offshore on Sunday ... if there is one death it will be on your conscience.”

McKay said it was “just not appropriate” to allow the ship to leave while unwell crew were onboard.

“They are scared, they are anxious, they have not been consulted at all about what’s happening to them,” she said.

She added that it was unacceptable that many of the crew had been locked in cabins since March 20 and some had still not been tested for coronavirus.

“How is that appropriate?” she said. “Who is in charge here?

“We have an international commitment to these people.”

I don't share her view that they shouldn't be locked in their cabins (if they are sick they should NOT be out and about) but I think they should all be tested.

Im not familiar with Maritime law...but I would imagine with a Coroners Inquest pending, a Police investigation
pending, and a special commission of inquiry announced...wouldn't it be appropriate for the ship to stay in Australian waters
to enable all witnesses to interviewed by various officers...or is the tax payer going to have to pay for all the witnesses
to be flown back to Sydney for the various hearings....maybe Virgin can fly them all back on their non existent airline... :rofl

I also think it is a strange time to be pushing them out to sea. I guess it is all motivated by fear and no-one really knows what to do. Image

yes, If I was onboard, I'ld be looking at getting onto a lifeboat to make my way to shore.

"Port state jurisdiction 3.23 If a criminal act occurred when the ship is in internal waters (all waters landward of the TSB) having visited a port or about to visit a port, or when the ship has departed the port and is now in the territorial sea of Australia (12nm from the TSB), then Australia can claim jurisdiction over the alleged criminal offence, provided that the relevant criminal legislation expresses its extra-territorial application.11 3.24 However, minor matters, such a petty theft, are often left to the Master of the Ship. Dr Lewins explains: … it is commonplace for the port State to leave the minor matters on board to the so called ‘internal economy’ of the ship. The ship is not, after all, a lawless place; as the laws of the flag State apply to it.12 3.25 The concept of a ‘flag State’ and its jurisdiction are described later in this Chapter. 3.26 More significant crimes, such as assault, manslaughter or murder, are said to engage the ‘interests’ of the port State. Consequently, the laws of the port State can and will apply as their enforcement is an exercise of sovereignty and relate to the ‘peace, good order and government’ of the State...."

I think that means that if the ship leaves territorial waters (is more than 12 nautical miles off shore) it can piss off
and we cant do a thing about it.....unless someone is charged with manslaughter...and that probably wont happen if the coppers
think it will take six months to complete their investigations with 2000 crew to interview and 220 leads to follow up...
I think it will leave on Sunday if the Captain hasn't got the virus....cant remember..I thought I read somewhere that he was crook..
...dunno if he has been tested or not....poetic justice one might think.... :roll:

I am thinking it will be a lot harder to conduct their investigation with the ship gone but it's probably a waste of money anyway as I doubt anything will come of it. Who knows though.

This whole thing just gets worse. Yes, with the ship gone, an investigation is impossible.
We save money on a useless obvious 2 year witch hunt. The people on the ship are like on the Ancient Mariner.

Im not going to google it.....but I wonder if there is a legal precedent for the ship to be seized..
Even then...does that mean the crew are all confined to the ship..who guards them..who
ensures they don't sneak off and vanish into the city...who pays for their confinement...
The mind boggles....its a can of worms...
