A Sydney shopping centre security guard who kidnapped and indecently assaulted a three-year-old girl has been jailed for more than two years.
Mohammad Hassan Al Bayati, 30, touched the young girl’s underwear and exposed himself during the 11 minutes they were in a stairwell — away from surveillance cameras — at DFO Homebush in December 2016.
NSW District Court Judge John Pickering today said the girl had been “quite remarkable” to report the crimes, and jailed the guard for four-and-a-half years with a minimum of two-and-a-half years.
Responding to a report the girl was unattended and distressed at the centre’s playground, Al Bayati took her by the hand to the stairwell just before 1.30pm.
Eleven minutes later, after receiving sexual gratification, he walked her back to the playground where her seven-year-old sister was crying because she couldn’t find her younger sibling.
The mother, having returned from shopping, was also waiting there and was quickly berated by Al Bayati.
“The gall of the offender to lecture the mother about the dangers and risks of leaving her in the play area when he ended up being the greatest risk is one of the most curious parts in this matter,” Judge Pickering said.
“Any mother should be entitled to leave their children in a busy shopping centre and not have any belief or expectation that someone who is actually there to look after the interests of people shopping in the centre will then create harm in themselves.”
The girl had been left in the DFO play area with her seven-year-old sister while their mother went shopping for Christmas presents.
Judge Pickering said there was “not point trying to make sense” of Al Bayati’s crime, describing it as an “incredibly risky and extraordinary move”.
“As is the case so often in matters of this nature, trying to think logically about why someone would try to behave in such a way to a three-year-old is pointless,” he said.
Al Bayati was found guilty of the crime in May. A jury from a previous trial had been unable to reach a verdict.
Earlier this year, the Crown told the court Al Bayati’s consistent denial of any wrongdoing should be focused on.
Police gave Al Bayati multiple opportunities to explain why he was in the stairwell with the child but never gave a straight answer, claiming he was helping her look for her mum.
The former security guard’s barrister earlier told the court the DNA found on the three-year-old suggested any touching done by Al Bayati had not lasted long.

The three-year-old did not initially tell her mum about the assault but told her dad later that afternoon and referred to a “police man” and his “bum bum”.
Later speaking to police, the girl told officers Al Bayati “said I have to kiss his bottom but I didn’t want to”.
In sentencing today, Judge Pickering also took into account Al Bayati arriving to Australia by boat as an Iraqi refugee a decade ago.

Did this Iraqi muslim refugee thigh this young child? Thighing is rubbing his penis between her thighs which is something Islam allows with children.
I wonder if this is the cultural enrichment lefties say we need from these muslim refugees.

I don't know about thighing but traces of him were found on her underwear. I agree he should be deported but before he serves his puny jail sentence. We all know that won't happen though.

Why are these people given jobs of trust in security? They really are a bad risk. Many are also found in baggage at the airports. Again not a good risk to take.
Most of them destroyed their papers on the voyage over and we have no clue who or what they are. It's lunacy.

Christians next, hey? They'd better watch out, hadn't they? Afterall, they had an entire Royal Commission that pretty well nailed a whole lot of them and their clergy, now didn't it?
Come on, fair's fair. If you're going to pick on all Muslims 'cause of one man's efforts, lets pick on all Christians because about 15% of their priests are Paedophiles, according to what the Royal Commission found IIRC.

If an "entire group" came into your country by illegal and\or untraceable means, why not discriminate against them for positions of security and public trust? What was this pervert doing before he came to Australia? Did he have a criminal record then? You have no way of knowing. Why don't you make him head of airport security while you are at it?
Do you have uninvited Christians, Jews, Hindu, and Buddhists? I wouldn't want them to be cops where I live. We saw where that socially promoted Somali cop shot that Aussie lady in the US last year. Maybe he can sneak into Australia and take this perverts job position with a different name when he gets out of our prisons.

Spoken like a typical alarmist. Australia has far stronger immigration controls than the US, Tex. It comes from being an island continent, completely disconnected from neighbouring countries. We also have a Government that has politicised the matter of immigration very strongly - they want to appear tough, they are locked into appearing tough. Our Navy and coast guard patrol the oceans around Australia rigorously. Sometimes they miss though and sometimes Asylum seeker boats get through their "ring of steel". Their passengers are immediately captured and dispatched to Nauru Island to be incarcerated or deported back to their countries of origin. Because of the politicisation of the issue, the Government is unwilling to listen to their plight, unfortunately.
If this person was here as a refugee, he had been judged by the Immigration Department to be a genuine refugee. That doesn't turn him immediately into a perfect character. However, we are a long, long ways from your situation. Just because a person is a Muslim or a Somali or a Sudanese refugee, does not automatically make them a danger to the society. Simply landing them in Australia and abandoning them as happens all too often does have it's dangers though.
