Looks like 2day FM have won their right to appeal the AMCA's decision.
Sydney pop music station Today FM has won its legal challenge to the communication regulator’s right to investigate whether it broke the law during the so-called “royal prank” broadcast.
The Federal Court has granted Today’s appeal and ruled that a finding by the Australian Communications and Media Authority that the station had breached its licence conditions be set aside.

Looks like they won their appeal, meaning that AMCA has to wait for a prosecution in the courts to determine that 2day FM breached the conditions of it's broadcast licence by committing an offence under the NSW Surveillance Devices Act. Seems pretty obvious that they did, but I guess they deserve their day in court... I wont hold my breath
