Whaling court action may fail: Garrett

Australia could fail in its bid to legally end Japan's scientific whaling program in the Southern Ocean, federal Environment Protection Minister Peter Garrett says.

The federal government announced in late May it would launch legal proceedings in the International Court of Justice (ICJ) against Japan.

The action in The Hague comes more than two years after Labor's 2007 election promise to pursue the matter in the court.

Mr Garrett conceded Japan could beat Australia in the ICJ.

"If they were to win the case, yes it would make it more difficult for the issues that we are trying to prosecute," he told ABC Television's Q and A program.

"There's risk in all of these activities when you go into a court."
