Fact is that he did not give secret unsolicited advice to the ALP. Dreyfus rang him, and asked if it was correct that Brandis had consulted him about the 'radical' Direction. He was entitled to answer because Brandis was out in the public arena saying that he had consulted Gleeson. He was publicly verballing the Solicitor-General.
