The exact same argument was made successfully here, as the religious underpinning for the Defense of Marriage Act and state level marriage laws are all based on religious belief, violating the Establishment Clause of the First Amendment of the Bill of Rights of the US Constitution. I would buy that except the law recognises and give extra rights to the partners in a marriage. Allow gays to marry gives each partner the same rights for example in a separation, taxation or on death. They should be afforded these rights.

Where they get married I think is an issue and it should be the right of the churches to decide if they will conduct these ceremonies depending on if they think their version of god approves it or not.

My point is Marriage is a legal term. I am not sure if in Australia they have exactly the same rights. if they have.... then it is an issue only can they claim to be "married" vs having a legal partnership under law.
