You're missing my point entirely, dude. What I'm trying to figure out is how you guys somehow arrived at discrimination laws should effect religious institutions. Here we have a right to religious freedom, and we also have protections against intruding on free religious speech. We balance the rights to religious expression vs anti discrimination laws through the tax exempt status of religious institutions. It get fucked up because of 6 years of a leftwing govt with a bat shit insane Attorney General who was on her way to produce the next round of anti-discrimination laws where it would have been made illegal to "offend or insult" based on 'political opinion' amongst other things, but they were tossed out of govt before they could get it passed.

If a charity or church in the US wants to qualify for and keep a tax exempt status they have to meet certain requirements. For example, religious institutions are forbidden from using their faith to coerce their parishioners to vote a certain way during elections. If a religious group wants they can forgo the tax exemption and they can discriminate all they want with in the bounds of lawful free speech. But if they want tax exempt status they have to obey federal guidelines in accordance with the US Constitution and Federal statute.

We had the exact same same stuff under the Deference of Marriage Act. Section 3 of DOMA also had a definition of marriage as being between a man and a woman.
