Oh yeah. It IS illegal to distill alcohol either with a still or by freeze-distilling, but they don't bother you if you use a little still and don't sell the spirit.

Most people ferment 8Kg sugar to give a 18-20% 'wash' clarify it then distill using a reflux still.

A few either make wine, grape or other fruit, or do a mash (malt, plus corn or rye etc) or ferment a heap of molasses then ferment (sometimes adding sugar to make higher alcohol concentration then running that through a pot still which carries over the flavors/aromas that a reflux still removes.
