But I am somewhat surprised and disappointed that, while Obama mouths platitudes of welcoming discussion about programs such as this, his government is ruthlessly pursuing the whistleblower who initiated this conversation. I'm disappointed that whistleblowers are not okay for this president.

There are established guidelines for whistleblowers in the US. Mr. Snowden didn't follow any of them and instead chose to release classified information publicly, which is a criminal offense. Had he obeyed proper procedures he could have blown the whistle and done so with complete legal protection.

The program s very likely unconstitutional.

And here's an example of none of you understanding the US Constitution or related USSC case law. If you did understand it, you'd know that their are multiple exclusions to the Fourth Amendment that have been vetted by the US Supreme Court (they're the only people that actually have anything to do with deciding if a law meets constitutional standards or not), as well as multiple acts of congress allowing for programs like PRISM.

I certainly can't imagine data mined evidence being allowed in a criminal case.

It gets used in criminal cases quite often. How else are you supposed to gather electronic evidence without using data mining techniques?

Obama has now now charged more under the espionage act than all other us presidents... ...combined. This is stark contrast to the ideals of government that candidate Obama portrayed.

I dare you to actually qualify that statement. I can name five presidents off the top of my head that have done more with espionage than Obama has ever even considered. One that immediately springs to mind would be President George W Bush, who was the sitting President at the time PRISM was authorized.

Prior to Barack Obama's inauguration, there were a grand total of three prosecutions of leakers under the Espionage Act (including the prosecution of Dan Ellsberg by the Nixon DOJ). That's because the statute is so broad that even the US government has largely refrained from using it. But during the Obama presidency, there are now seven such prosecutions: more than double the number under all prior US presidents combined. How can anyone justify that?

From 1918 with the usage of the Sedition Act inclusions to the 1917 Espionage act there have been several thousand people either charged and convicted of crimes under the Espionage Act or deported under the provisions of the act. The Woodrow administration had put over three dozen people in prison for sentences of ten years or more, prevented the release of a movie (The Spirit of '76), deported several hundred citizens, and had the first USSC hearing over the constitutionality of the Act during his Presidency.

So again, I dare any of you history challenged motherfuckers to qualify the statement that Obama has utilized the Espionage Act more than any previous President.
